Terms of Service

By downloading, installing, or using SnapShotAI ("the Software"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Software.

1. Acceptance of Terms

By creating an account or using SnapShotAI, you confirm that you are at least 18 years old (or the age of majority in your jurisdiction) and agree to comply with these Terms. If you are using the Software on behalf of an organization, you represent that you have authority to bind that organization.

2. Description of Service

SnapShotAI is a screen capture tool that uses artificial intelligence to analyze screenshots. The Software includes a stealth mode feature that makes the AI overlay invisible to screen sharing and recording applications.

3. User Responsibility and Conduct

You are solely responsible for how you use SnapShotAI. You agree that:

• You will use the Software in compliance with all applicable local, state, national, and international laws and regulations.
• You will not use the Software to violate any academic integrity policies, honor codes, or exam proctoring rules at your educational institution.
• You will not use the Software to gain unauthorized advantages in professional certifications, licensing exams, or standardized tests.
• You will not use the Software for any fraudulent, deceptive, or illegal purpose.
• You are responsible for understanding and complying with the rules of any environment in which you use the Software, including but not limited to classrooms, workplaces, and online meetings.
• You will not reverse-engineer, decompile, or modify the Software for malicious purposes.

4. Disclaimer of Liability

SnapShotAI and its creators, developers, and affiliates ("we," "us," "our") shall not be held liable for any consequences arising from your use of the Software. This includes, but is not limited to:

• Academic disciplinary actions, suspensions, or expulsions
• Termination of employment or professional consequences
• Legal actions, fines, or penalties imposed by any authority
• Violations of third-party terms of service (e.g., Zoom, Microsoft Teams, Discord, OBS)
• Any direct, indirect, incidental, consequential, or punitive damages

The stealth mode feature is provided as a technical capability of the Software. We do not encourage, endorse, or condone the use of this feature to violate any rules, policies, or laws. The decision to use any feature of the Software, and the context in which it is used, is entirely your responsibility.

5. No Warranty

The Software is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that:

• The Software will function uninterrupted or error-free
• AI-generated responses will be accurate, complete, or reliable
• The stealth mode feature will work in all environments or with all screen capture software
• The Software will be compatible with your system or meet your specific requirements

6. Indemnification

You agree to indemnify, defend, and hold harmless SnapShotAI and its creators, developers, officers, directors, employees, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to your use or misuse of the Software, your violation of these Terms, or your violation of any rights of a third party.

7. Privacy and Data

Screenshots submitted for AI analysis are processed in real-time and are not stored on our servers. We collect only the minimum data necessary to operate the service:

• Email address (for account authentication)
• Usage count (number of captures per billing period)
• Subscription status

We do not sell, share, or distribute your personal data to third parties.

8. Subscription and Payments

Free accounts are limited to 15 captures per month. Pro subscriptions ($5.99/month) provide unlimited access. Payments are processed securely through Stripe. You may cancel your subscription at any time from your dashboard; access continues until the end of the billing period.

9. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for conduct that we determine to be in violation of these Terms or harmful to other users, us, or third parties.

10. Changes to Terms

We may update these Terms from time to time. Continued use of the Software after changes constitutes acceptance of the updated Terms. We will make reasonable efforts to notify users of significant changes.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
